A US Court of Appeals for the Federal Circuit on Tuesday upheld an earlier decision to delay the approval of Teva's generic version of Eli Lilly's Evista (raloxifene) until a patent-infringement trial over the osteoporosis drug begins on March 9. Teva was expected to be allowed to introduce a generic version of the drug in November 2008, but Eli Lilly obtained a court order preventing the FDA from approving Teva's formulation until the March trial starts.
